By signing up as a member, you acknowledge that we are not providing financial advice and that you are making a decision to copy our trades on your own account. We have no knowledge on the level of money you are trading with or the level of risk you are taking with each trade. In this regard, the amounts paid for the use of our signals can’t be refunded.

By signing up to Getting Started In Crypto, you sign up to an automatic subscription (unless you pay by crypto). It is your responsibility to cancel the subscription should you wish to end the payments. We cannot offer a refund (other than mentioned in the Refund Policy) if you do not cancel your subscription.
To cancel your membership, you’ll need to log in and go to My Account in the Menu and choose to cancel your Subscription or log in to your payment gateway (PayPal) and cancel it from there. You will still have access for the remainder of you subscription but the payment won’t renew going forward.

Affiliate referrals and payment decisions will be at the final discretion of Getting Started In Crypto. If a referral has been refunded, the affiliate commission will not be paid out. The terms for the affiliate scheme may change at any term without notice.

(i) there will be operational stability, availability or continuation of the services provided on the Platform;

(ii) the Platform will be uninterrupted, secure, reliable, timely, error-free or free from any virus, malware or any other digital attack;

(iii) the Platform will be safe from unauthorised access, fraud or any other illegal or suspicious activity;

(iv) no third party rights will be infringed as a result of your use of the Platform; and

(v) there will be any continuation of the agreement formed under these Terms.

You acknowledge that your use of the Platform is at your own discretion and in compliance with all applicable laws.

Security

It is your responsibility to ensure that any details used to access the Platform, as well as the device you use to access the Platform, are kept safe by taking reasonable steps to prevent any loss, damage, theft or misuse from taking place, including password protecting your device, enabling two-factor authentication (2FA) and encrypting any data.

You should never provide your password or 2FA code to any third party, including us. We will never ask you for your password or 2FA code; anyone who asks for this information is likely to be impersonating us or one of our employees or representatives. We will not be liable for any loss that is sustained as a result of your account details being compromised.

If you suspect that your account has been compromised, or if you become aware of a fraud, attempted fraud, or any other security breach, please contact us as soon as possible. You will be required to provide us with accurate and up to date information throughout the duration of the incident and take any steps necessary to mitigate or manage the consequences of the incident.

Rights We Reserve

We reserve the right to change or discontinue any and all aspects of the Platform at any time without your consent.

We reserve the right to refuse to complete transactions.

We reserve the right to restrict or block your access to the Platform if we believe, at our sole discretion, that you have breached these Terms, any applicable laws, or are otherwise using the Platform in such a way that undermines the integrity of the Platform, our brand, or our licensors brand. We also reserve the right to contact third parties for the purposes of notifying or warning them about your actions.

If necessary, we reserve the right to take legal action against you.

Entire Agreement

These Terms and all documents referenced in these Terms comprise the entire agreement between you and us in relation to your use of the Platform and supersede all prior agreements between the parties.

Additional Terms (with application to the LisaBot)

We offer a Platform (“Platform”) as a service (SaaS) through our website https://bot.gettingstartedincrypto.com/ (the “Website”). Our Platform enables you to trade and invest in cryptocurrencies by means of an automatic crypto trader bot – of which you (solely) control and configure the settings. The Platform and Website, hereinafter jointly be referred to as our “Services”.

These terms and conditions (the “Terms”) apply to the relationship between Getting Started In Crypto and you and to any and all use of our Services. The use of our Services is conditioned upon your acceptance of and compliance to these Terms.

Definitions

LisaBot: A service from Getting Started In Crypto, Visual Media Group Pty Ltd a limited liability company incorporated under the laws of Victoria, Australia. LisaBot is also referred to as “we”.
Account: the Account on the Platform created by User, which is limited for use by User via the Login Credentials.
Signals: recommendations for buying or selling cryptocurrencies shared by gettingstartedincrypto.com. Users have the option to configure the software on the Platform as such that it will automatically buy currencies on the basis of information of these Signals.
Platform: the platform LisaBot has developed to enable Users to connect with gettingstartedincrypto.com, enabling Users to trade in crypto currencies on the crypto market using a crypto trader bot and in accordance with Signals provided. The Platform is available through the Website.
Subscription Term: the Initial Term of the Subscription, plus any subsequent renewal subscription term(s).
User(s): individual private person(s) or legal entity(ies) making use of the Services. Users are also referred to as “you”.

Registration and personal account

You may not allow use of your Account by any third party. You are fully responsible for non-disclosure of your Login Credentials and the use of your Account. If, for whatsoever reason, your Account is blocked or deleted, you are no longer entitled to use the Platform, e.g. by using another Account and/or creating a new Account. You warrant that the information provided when creating an Account is correct and complete. You are responsible for the accuracy of the data in your Account. LisaBot is entitled, at all times, to no longer make available certain functionalities of the Account, Platform or other Services, to not grant an Account to any person and to demand additional requirements for granting an Account.

Offers and prices

LisaBot has the right to amend its prices at any time. Such price change may take effect immediately. LisaBot cannot be held to an offer or quotation that can reasonably be understood to contain an obvious mistake or error.

Subscription

You need a subscription to use all the functions of the Platform (the “Subscription”). Subscriptions are offered for a fixed amount per month and/or per year. You can apply for a Subscription on our Website. Without prejudice to the other provisions in these Terms, the Subscription shall commence and expire in accordance with the start date and end date indicated in the subscription package, unless earlier terminated by User in accordance with this article or by LisaBot if User violates these Terms and/or applicable laws and regulations (the “Initial Term”). LisaBot will give User access to the Platform corresponding to its Subscription immediately on the start date of such Subscription. After the Initial Term, the Subscription shall automatically renew for the same period as the Initial Term, unless LisaBot or User gives written notice via the Website or Platform to the other of its intention not to renew the Subscription.

Payment

The price of the subscription will be paid every month by User. Possible methods of payment are displayed on the Website and include for example PayPal, credit cards (e.g. Visa or MasterCard) and cryptocurrencies. In the event LisaBot is unable to collect the fees due, or User does not pay the fees within the period as referred to in article 5.1, LisaBot has the right to disable any functionality of the Platform or Account to the User, without prejudice to any other rights LisaBot may have. The Account of the User will remain active for the period that User has already paid for.

Fair use of our Platform

You must be at least 18 years old to use our Platform. You may not use the Platform (or other Services) in such way that you violate Australian and any other applicable law and regulations, including but not limited to financial and taxation regulations. As a condition for using the Platform (or other Services), you agree not to provide any information, data or content to us or the Platform that is incorrect, inaccurate, incomplete or that violates any law or regulation, or is unacceptable to general standards. In addition, you agree that you will not, nor allow third parties to engage in, among others, the following actions:

enter any non-public / secure areas of the Platform (or other Services);

end viruses, worms, junk mail, spam, chain letters, unsolicited offers or ads of any kind and for any purpose;
investigate, scan, or test the Platform (or other Services) or any other related system or network, or violate any security or authentication;
use any automated systems to withdraw data from the Platform (or other Services) (“screen-scraping”);
make and distribute copies of the Platform (or other Services);
attempt to sell, distribute, copy, rent, sub-license, loan, merge, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, translate, hack, distribute, harm or misuse the Platform (or other Services); or
create derivative works of any kind whatsoever. LisaBot may disable any functionality of the Platform (or other Services) temporarily or permanently, if User violates this clause and/or other provisions of the Terms and/or generally causes damage to LisaBot, Users and/or Signal Providers.

Privacy

When you make use of our Services, we will collect certain personal data from you. In our Privacy Policy you can read which personal data we collect and for what purposes.

Intellectual property

LisaBot is the exclusive licensee of all intellectual property rights vesting in and relating to (all content made available through the use of) our Services, such as – but not limited to – patents, patent applications, trademarks, trademark applications, database rights, service marks, trade names, copyrights, trade secrets, licenses, domain names, know-how, property rights and processes (“Intellectual Property Rights”). As long as User complies with all its obligations, User obtains a non-exclusive, non-transferable, non-sublicensable and revocable license for use of the Services in accordance with these Terms and the Subscription. If User no longer complies with its obligations, LisaBot can withdraw this license with no notice of default being required.

Availability of the Services and disclaimer of warranties

The Platform is available on computers, handheld mobile devices running on iOS and Android and other devices specifically indicated as compatible by LisaBot. LisaBot uses all reasonable efforts to ensure that you can access and use the Platform at all times. Due to the nature of the services offered, LisaBot cannot guarantee the error-free and uninterrupted access to- and functioning of the Platform. LisaBot is in no way responsible for the quality or content of the Signals. The results of selected Signals are entirely at the risk of the User. LisaBot does not accept any responsibility for unavailability of the Platform (or Services), or any difficulty or inability to download or access content, or any other communication system failure which may result in Services being unavailable. LisaBot may – at its own discretion – update, modify, or adapt the Platform and their functionalities from time to time and shall strive to keep downtime to a minimum. LisaBot is not responsible for any support or maintenance regarding the Platform (or other Services), and/or any downtime resulting from these actions. To the maximum extent permitted by applicable law, LisaBot hereby disclaims all implied warranties regarding the availability of the Platform (or other Services). The Services are provided “as is” and “as available” without warranty of any kind. LisaBot takes the utmost care in compiling its Services for you. However, we cannot vouch for third parties involved in the use of- and access to our Platform (or other Services). For third parties used by the User, the User is solely responsible. LisaBot and User agree to the following limitation of liability with respect to the use of the Services:

Unless there is willful misconduct or gross negligence on the part of LisaBot, LisaBot is not liable in any way for Users’ (direct or indirect) damages or costs of whatsoever nature. LisaBot is not liable for damage of User that occurs due to the fact LisaBot assumed incorrect or incomplete information provided by User to be correct or complete in the execution of the Agreement. If LisaBot is liable, for any reason, the liability will be limited to an amount of $100 USD. Without prejudice to other provisions in these Terms, LisaBot is not liable for any damage resulting from (no or limited) access to and use of the Platform (or other Services) or the content provided thereon, including loss of profit arising in any way from, but not limited to:

the operation or unavailability of this Platform (or other Services); downloading or using any functions and/or software available through our Platform (or other Services);  claims of third parties (or regarding third parties) in connection with the use of the Platform (or other Services); loss of data; the proper functioning of (hyper)links available through our Platform (or other Services); the quality of any template containing LisaBot settings, provided by Users on the Website; the (lack of) financial benefit for the Users through the use of the Platform; any situation where Users mobile devices and/or login Credentials are stolen and any third party subsequently makes use of the Services without User’s consent; any damage or alteration to User’s equipment including but not limited to computer equipment or a (handheld) device as a result of the installation or use of the Platform (or other Services); any damage incurred due to the use of an exchange that our Platform is using for trading or otherwise connected to or due to the use of any other third party required, for example as a result of unavailability or insolvency thereof; or a failure to meet any of LisaBot’s obligations under these Terms where such failure is due to events beyond LisaBot’s reasonable control.

LisaBot is not liable for any data and information on the User-Forum and Question-Section. LisaBot may remove content and information from the User-Forum and Question-Section if we are notified that the content or information is unlawful, violating these Terms or is otherwise inappropriate.

LiveChat

LisaBot has a Live Chat on the gettingstartedincrypto.com website where User can ask questions about the Services. LisaBot will only give advice about the functioning of the Services.
LisaBot explicitly does not:

Give Users any personal advice on recommended settings for the LisaBot; Give Users any personal financial advice. LisaBot may upload general tutorials and videos on the Website, about the functioning of the Services. All tutorials, videos and templates uploaded by LisaBot are general and contain in no way personal and/or financial advice. All use of these tutorials, videos and templates is at the sole risk of the User. All use of Signals is at the sole risk of the User.

Risks

The use of our Services is only suitable only for Users that fully understand the risks involved in such use. This, inter alia, implies that you understand the price volatility in the cryptocurrency market and that the potential loss in trading or holding crypto currencies can be all or substantial. You guarantee that you shall only put in money that you can afford to lose. You warrant that you are aware that additional risks of trading cryptocurrencies may exist that have not been set forth in these Terms, our Website and/or on our Platform. You understand that it remains at all times your responsibility to carefully assess all the risks and determine whether your level of knowledge, financial standing and tolerance for risk are suitable for the use of our Services and the use of cryptocurrencies which are part of a volatile market. Moreover, you are aware of the risks associated with the use of our Services, among which the risk of possible errors and interruptions, and you assume full responsibility for these risks. At no point, LisaBot provides any investment, legal or tax advice. LisaBot does not consider your personal circumstances (among which, your financial situation and investment objectives). If you wish to receive such advice or considerations, it is your responsibility to seek independent, professional advice prior to the use of our Services.

Indemnification

User will indemnify, defend, and hold LisaBot harmless from and against all liabilities, damages and costs (including settlement costs and reasonable attorneys’ fees) arising out of third-party claims regarding: any injury or damages resulting from behaviour of User related to the use of our Services; and breach by User of these Terms or violation of any applicable law, regulation or order.

Hyperlinks

Where LisaBot provides hyperlinks to third party websites, such links are not an endorsement by LisaBot of any products or services provided on or via such websites. The use of such hyperlinks is entirely at your own risk. LisaBot accepts no responsibility or liability whatsoever with regard to the content, use or availability of such websites. The veracity, accuracy, reasonability, reliability and completeness of information contained on such internet sites has not been verified by LisaBot.

Miscellaneous

LisaBot reserves the right to change these Terms. By continuing to use the Services, you acknowledge the most recent version of these Terms. If we do not enforce (parts of) these Terms, this cannot be construed as consent or waiver of the right to enforce them at a later moment in time or against another User. User cannot transfer the rights and obligations from these Terms to third parties. The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision of these Terms. Any such invalid or unenforceable provision shall be replaced or be deemed to be replaced by a provision that is considered to be valid and enforceable and which interpretation shall be as close as possible to the intent of the invalid provision. These Terms shall exclusively be governed by and construed in accordance with the laws of Australia. Unless mandatory law compels differently, all disputes resulting from or arising in connection with these Terms shall be exclusively submitted to the competent court of Victoria, Australia, unless the dispute can be settled in an amicable fashion.

LisaBot strives to give you optimal service. If you have a complaint, comment or suggestion, you can contact us at [email protected]. Please provide us with your contact details, and a clear description and reason for your complaint. Complaints are usually processed within 7 working days.

Affiliate Scheme Terms

Affiliate Terms of Use
As an authorized affiliate (Affiliate) of Getting Started In Crypto, you agree to abide by the terms and conditions contained in this Agreement (Agreement). Please read the entire Agreement carefully before registering and promoting Getting Started In Crypto as an Affiliate.

Your participation in the Program is solely to legally advertise our website to receive a commission on memberships and products purchased by individuals referred to Getting Started In Crypto by your own website or personal referrals.

By signing up for the Getting Started In Crypto Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

Approval or Rejection of the Application
We reserve the right to approve or reject ANY Affiliate Program Application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

Commissions
Commissions will be paid once a month. For an Affiliate to receive a commission, the referred account must remain active for a minimum of 31 days.

You cannot refer yourself, and you will not receive a commission on your own accounts.

Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be paid out.

Termination
Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
Spamming (mass email, mass newsgroup posting, etc.).
Advertising on sites containing or promoting illegal activities.
Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
Violation of intellectual property rights. Getting Started In Crypto reserves the right to require license agreements from those who employ trademarks of Getting Started In Crypto in order to protect our intellectual property rights.
Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive. Adding bonuses or bundling other products with Getting Started In Crypto, however, is acceptable.
Self referrals, fraudulent transactions, suspected Affiliate fraud.
In addition to the foregoing, Getting Started In Crypto reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason.

Affiliate Links
You may use graphic and text links both on your website and within in your email messages. You may also advertise the Getting Started In Crypto site in online and offline classified ads, magazines, and newspapers.

You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in the Termination section.

Coupon and Deal Sites
Getting Started In Crypto occasionally offers coupon to select affiliates and to our newsletter subscribers. If you’re not pre-approved / assigned a branded coupon, then you’re not allowed to promote the coupon. Below are the terms that apply for any affiliate who is considering the promotion of our products in relation to a deal or coupon:

Affiliates may not use misleading text on affiliate links, buttons or images to imply that anything besides currently authorized deals to the specific affiliate.
Affiliates may not bid on Getting Started In Crypto Coupons, Getting Started In Crypto Discounts or other phrases implying coupons are available.
Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has expressed a clear and explicit interest in activating a specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.
User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).
Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation, when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.
Pay Per Click (PPC) Policy
PPC bidding is NOT allowed without prior written permission.

Liability
Getting Started In Crypto will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).

We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by Getting Started In Crypto. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.

Term of the Agreement
The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.

The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

Indemnification
Affiliate shall indemnify and hold harmless Getting Started In Crypto and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by Getting Started In Crypto to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Affiliate.

Electronic Signatures Effective
The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Getting Started In Crypto affiliate program. You indicate your acceptance of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Getting Started In Crypto application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
